Terms & conditions
1. Scope & supplier
These terms and conditions apply to every order placed through primos-del-patron.ch between Primos del Patrón GmbH, Gärbigasse 17, 6215 Beromünster, Switzerland (CHE-000.000.000, CHE-000.000.000 MWST), 'we', and you as the customer. Differing terms apply only where we have expressly agreed to them. You can reach us at info@primos-del-patron.ch.
2. Membership & account
Our range is reserved for an invited circle: you can order once you have redeemed a valid invite code and opened an account. Your details must be complete and accurate, your credentials kept confidential and are not transferable. We may suspend or delete an account that is misused, in particular where it is passed to minors, where details are false, or where goods are resold commercially without our agreement.
3. Minimum age 18
We supply cigars only to people aged 18 and over (Swiss Tobacco Products Act, TabPG). By placing an order you confirm that you have reached that age. We reserve the right to verify age, to decline an order without giving reasons, and to make handover of the parcel conditional on valid identification. Passing the goods on to minors is prohibited.
4. Products & availability
Our cigars are hand-rolled natural products. Wrapper colour and grain, draw and aroma can vary slightly from box to box; photographs are illustrative and are not a warranty of any particular quality. Details of format, strength and origin describe the respective vitola to the best of our knowledge. Offers apply while stocks last; we work with small batches and may withdraw individual vitolas without notice.
5. Conclusion of contract
The display in the shop is not a binding offer but an invitation to order. By submitting your order you make a binding offer. The contract is concluded when we accept the order with an order confirmation by email; the automatic acknowledgement of receipt or of payment alone is not enough. If an item is no longer available after your order arrives, we may withdraw from the contract; any amount already paid is refunded in full without delay.
6. Prices
All prices are in Swiss francs (CHF) and include statutory VAT as well as the duties payable on tobacco products. Shipping of CHF 12 is added; from an order value of CHF 200 we ship free of charge within Switzerland. The price shown at the time of the order applies. Obvious pricing errors are not binding on us; in such a case we will tell you before executing the order.
7. Payment
We accept credit cards (Visa, Mastercard, American Express) and TWINT. Payment is handled by Stripe and is due with the order; we dispatch only once payment is confirmed. We neither collect nor store card data. If a payment fails or is charged back, we may hold the delivery and, after a reasonable grace period, withdraw from the contract.
8. Shipping & delivery
We deliver to Switzerland and Liechtenstein as well as to Germany, Austria, France and Italy. Dispatch is usually within two working days of payment; stated delivery times are indicative and not fixed dates. Partial deliveries are permitted and cost you nothing extra. Risk passes to you on delivery. Please report visible transport damage immediately and keep the packaging.
9. Abroad, customs & import
For deliveries abroad the import rules of the destination country apply. Customs duties, import and tobacco taxes and handling fees are borne by you and are not included in the price. Imports of tobacco products are limited in quantity and, in some countries, only permitted to a limited extent; you are responsible for the admissibility of the import. If a consignment is refused or seized by the authorities, we refund the value of the goods only to the extent that the consignment reaches us again.
10. Retention of title
The goods delivered remain our property until they have been paid for in full.
11. Inspection, defects & warranty
Please check the delivery for completeness and defects on receipt. Report visible defects, shortfalls or transport damage within 7 days of receipt to info@primos-del-patron.ch, and hidden defects immediately upon discovery. Where a complaint is justified we will, at your choice, replace the goods or refund the purchase price. The statutory warranty under Art. 197 et seq. CO applies; it does not cover changes caused by improper storage after delivery.
12. Returns & withdrawal
Swiss law grants no statutory right of withdrawal for online orders. For reasons of hygiene and product nature, exchange is excluded once the box, cellophane or seal has been opened. As a gesture of goodwill we take back unopened, originally sealed goods within 14 days of receipt, provided you agree the return with us beforehand; return postage is at your expense. Consumers domiciled in the EEA have the statutory 14-day right of withdrawal there, to the extent it is mandatorily applicable and not excluded for sealed goods. Your rights in respect of defects remain unaffected in every case.
13. Storage & handling
Cigars are sensitive: store them at around 16–18 °C and 65–70 % relative humidity. We cannot answer for loss of quality arising after delivery from drying out, excess humidity, mould or tobacco pests.
14. Reviews
Only customers with an account can leave reviews; they reflect that person's own assessment and are publicly visible. Untrue statements, insults, third-party advertising and content infringing the rights of others are not permitted; we may remove such contributions without notice. By publishing a review you grant us the right to display it on this website.
15. Liability
We are fully liable for intent and gross negligence. Liability for slight negligence is excluded as far as the law permits, in particular for indirect damage, lost profit and loss of data. Mandatory liability, notably under the Product Liability Act and for personal injury, is reserved. We are not liable for temporary unavailability of the website.
16. Force majeure
Events of force majeure, such as natural events, epidemics, official measures, strikes, customs or transport disruption, and losses at the manufactory, release us from the duty to deliver for as long as they last. If the disruption lasts longer than 60 days, either side may withdraw from the contract; payments already made are refunded in full.
17. Data protection
How we handle personal data is set out in our privacy policy, which forms part of these terms.
18. Changes to these terms
We may change these terms at any time. The version published on this website at the time of your order applies to that order.
19. Governing law & jurisdiction
The contractual relationship is governed exclusively by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-law rules. Place of jurisdiction is Beromünster, Switzerland; mandatory places of jurisdiction, in particular in favour of consumers, are reserved. If a provision of these terms is invalid, the remaining provisions stay unaffected.
